Following the Special Meeting held at Mataatua Marae, 11 June 2011, the landowners present

decided they would like more time to discuss the following options with the beneficiaries of the

respective blocks in response to the Trust Board advising it intends to surrender as responsible

trustee to Tuhoe Tuawhenua B Trust

Options:

1. Tuhoe Tuawhenua B Trust remain the entity to govern and administer the 8 blocks

2. Individual blocks at their own desire may withdraw from the current Tuawhenua B Trust and set up their  own trust

3. Transfer the administration to an exiting entity to continue the administration of the aggregated blocks as responsible trustee. [This may require a review of the preferred entity’s Trust Deed and Trustee- representation]

Maori Land Court Advice

The trust Board has sought the advice of the Maori Landcourt with regards to it’s efforts for the second time having called a hui for beneficial landowners of the Trust.

(a) The Trust Board provided adequate notification calling beneficial landowners to the 2 previous hui to discuss the items of Agenda

(b) The Trust Board provided all information in advance to those they had addresses for

(c) No issues were identified regarding the process for election of replacement trustee employed by the Trust  Board

(d) No issues were identified with the process to vary the Trust Order

The Maori Land Court advises that the Trust Board is under no obligation to host another hui.

However the Board is committed to the resolution from the meeting held Saturday 11, June 2011 to allow 3 months grace form that day for delegates to arrange discussions with respective beneficial landowners of the blocks.

Final Hui

A final hui to complete resolutions will occur on Saturday August 20, 2011 at Tipapa Marae, Ruataahuna

The Trust Board has received 4 nominations from the previous elections they will remain valid

for consideration at the scheduled meeting for August 20th 2011.

History

The blocks vested in this trust were previously part of a much larger amalgamation of 43 blocks. Following complaints to the MLC that owners were not given sufficient opportunity to consider the amalgamation proposal before Orders were made the Court re-opened the amalgamation application and gave owners the opportunity to state their views.

As a result of re-opening the application the Court found that the owners of the 8 blocks now comprised in the Trust preferred the TWMTB as Trustee and the blocks were vested in the TWMTB on the 20 November 1987.
